By accessing or using the services provided by Business Awareness Inc. ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Agreement"). If you do not agree, you must discontinue use of our services.
2. SERVICES PROVIDED
We provide marketing automation, customer relationship management (CRM), advertising, and related services. We reserve the right to modify or discontinue services at any time.
3. USER ACCOUNTS AND RESPONSIBILITIES
● You must provide accurate, current, and complete information when registering.
● You are responsible for maintaining the confidentiality of your login credentials.
● You must not use our services for any illegal or unauthorized purposes.
4. PAYMENT TERMS
● Fees for services are due as outlined in your agreement or subscription plan.
● Failure to make timely payments may result in suspension or termination of services.
● All payments are non-refundable unless otherwise stated.
5. INTELLECTUAL PROPERTY
● All content, trademarks, and intellectual property on the service remain the property of Business Awareness Inc. or its licensors.
● You may not copy, modify, distribute, or exploit any content without express written permission.
6. DATA PRIVACY AND SECURITY
● Our collection and use of personal data are governed by our Privacy Policy.
● You are responsible for ensuring compliance with applicable data protection laws when using our service.
7. PROHIBITED ACTIVITIES
● Use our services for fraudulent or deceptive practices.
● Distribute spam, malware, or harmful code.
● Infringe on intellectual property or proprietary rights.
● Interfere with the service’s operation or security.
8. DISCLAIMERS AND LIMITATION OF LIABILITY
● The services are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied.
● We are not liable for any indirect, incidental, or consequential damages arising from the use of our service.
● To the maximum extent permitted by applicable law, our total liability for any claims related to the services shall not exceed the total amount paid by you for the services in the twelve (12) months preceding the claim.
9. TERMINATION OF SERVICES
We reserve the right to suspend or terminate your account for violations of this Agreement or any applicable laws.
10. GOVERNING LAW AND DISPUTE RESOLUTION
● For Illinois-based entities: This Agreement shall be governed by the laws of the State of Illinois.
● For nationwide entities: This Agreement shall be governed by U.S. federal laws and the laws of the applicable jurisdiction.
● Any disputes shall be resolved through binding arbitration in Chicago, IL, in accordance with the rules of the American Arbitration Association, unless otherwise mutually agreed upon by both parties.
11. CHANGES TO THESE TERMS
We may update these Terms from time to time. Your continued use of our services constitutes acceptance of any modifications.
